BUILDING PERMIT APPLICATION GUIDELINES

 

1) Complete applications will facilitate prompt processing by the Village Building Department.

2) Each application should include the following:

Application Fee: $100 for the 1st $1000 of estimated cost of construction plus $10 for each additional $1000 or part thereof, based on a minimum of $150 per square foot. Plus $50 Certificate fee.

3) Permits are valid for nine (9) months: thereafter extensions must be applied for in writing whether work has commenced or not. A maximum of three (3) extensions, each of three (3) months duration, are allowed. Further extensions must be approved by the Board of Trustees. The first three (3) extensions cost $150 each. Thereafter the fee will be set by the Board of Trustees if the additional extension is granted. Additional insurance certificates should be submitted periodically to show continued coverage. If a new contractor is hired, the contractor must submit insurance and license to the Village prior to the commencement of any work.

 

4) If application plans do not meet all requirements, they must be revised as required by the Building Inspector prior to approval for a Building Permit. Changes may be submitted at later dates accompanied by an Amendment Form which is available at the Village Office (3 copies).

 

5) If the application is approved by the Building Inspector, the Building Department issues a Permit and the applicant receives two (2) stamped copies of the Plans. One copy is to be kept at the job site and made available to the Building Inspector at all times until a Certificate is issued.

 

6) Certain factors, such as a violation of New York State Uniform Fire Prevention and Building Code or of the Village of Sands Point Zoning Code, may necessitate denial of an application by the Building Inspector. The applicant may then apply for a variance and/or reversal of a denial to the Sands Point Board of Zoning Appeals or to the New York State Board of Review, whichever is applicable. Forms for Village variances are available from the Village office. Forms for variances or appeals from New York State Code may be obtained directly from the NY Department of State Codes Division, (518) 474-4073.

 

7) Upon submission of written notice of the date of commencement of work, the applicant or his/her representative will be notified by the Building Department as to when the Building Permit can be picked up.

 

8) Applicant must contact the Building Inspector to request each of the required inspections which are checkmarked on the Building Permit. Failure to schedule a required inspection may have serious consequences.

 

9) Upon the completion of construction, an application for a Certificate of Occupancy/Completion must be filed. The work must be complete and requirements indicated by checks on the Permit must be submitted prior to the issuance of a Certificate of Occupancy/Completion (which may include survey, signed and sealed certification by licensed professional, electrical underwriter’s certificate, final cost affidavit, etc.). All applicable fees must be paid in full prior to issuance of a Certificate. If these requirements are not met, the permit will remain open and extension fees continue to accrue.

 

10) The property owner and/or contractor, as agent for the owner, is the designated authority responsible for construction site safety in accordance with OSHA standards, including but not limited to: providing ground fault electrical protection, protection from open excavations, provision for water runoff, proper storage of construction equipment and materials, removal of construction debris, traffic safety in vicinity of construction site.

 

11) Signs identifying contractors are prohibited in the Incorporated Village of Sands Point.

 

12) The erection (including excavation), construction, demolition, alteration or repair of any building (except interior alterations or repairs to a building (except interior alterations or repairs to a building which take place entirely indoors), the operation of tractors, earthmoving or earth-excavating machines, cement mixers or cranes (collectively hereinafter referred to as "construction activities") in connection with excavating, filling of land or land development projects or the delivery of any such equipment to a project site other than between the hours of 8:00 AM and 5:00 PM on Mondays through Fridays is prohibited. In addition, work of this nature is not allowed other than between the hours of 9:00 AM and 4:00 PM on Saturdays, except as otherwise prohibited. However, construction on more than three (3) consecutive Saturday’s within a three (3) month period may be prohibited by the Building Commissioner at his discretion.

 

13) Some applications may require the Village to hire an outside consultant, the cost of which must be borne by the applicant.

 

14) The Building Department must approve any changes to the approved plans in writing before construction begins. Should minor changes be made "in the field", such changes are made at the applicant’s own risk and the as-built drawings must be submitted to the Building Department for approval.

 

15) If there are any changes to the professional (architect or engineer) of record, the Village must be notified in writing by the new professional of record.

 

16) Any applications, which receive approval from a Board, must receive final approval at the end of the project by that Board prior to the issuance of a Certificate of Occupancy/Completion.
